By accessing or using Backsurge ("Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use constitutes acceptance.
2. Description of Service
Backsurge is a content experimentation and analytics platform that allows creators to run A/B-style experiments on their video metadata (titles, thumbnails, descriptions) across connected social media platforms, and to track performance data. The Service is in early access and features may change.
3. Pricing, Plans & Billing
Backsurge offers both free and paid subscription plans. The free plan includes limited concurrent experiments, connected channels, and change history. Paid plans provide increased or unlimited access to these features. We reserve the right to modify pricing, plan features, and usage limits at any time. Changes to paid plans will take effect at the start of the next billing cycle, and we will provide reasonable notice of material changes via email or in-app notification. We may introduce, modify, or discontinue any plan or feature at our sole discretion. Your continued use of the Service after changes constitutes acceptance.
4. Eligibility
You must be at least 16 years old to use Backsurge. By using the Service, you represent that you meet this age requirement and that any information you provide is accurate and complete.
5. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to share your account with others or use another user's account without permission. Notify us immediately of any unauthorized use.
6. Third-Party Platform Connections
Backsurge connects to third-party platforms (including YouTube, TikTok, Instagram, and Facebook) through their official APIs. Your use of those platforms remains subject to their respective terms of service. We are not affiliated with or endorsed by those platforms. You are solely responsible for any API quota usage, policy violations, or account actions resulting from experiments you run through Backsurge.
7. Acceptable Use
You agree not to use Backsurge to: (a) violate any applicable law or platform terms; (b) upload or transmit harmful, misleading, or infringing content; (c) attempt to gain unauthorized access to our systems; (d) reverse-engineer or scrape the Service; or (e) use the platform for spam or deceptive practices.
8. Intellectual Property
Backsurge and its original content, features, and functionality are owned by us and are protected by intellectual property laws. Your content remains yours. By connecting your accounts, you grant us a limited license to access and display your content and analytics solely to provide the Service.
9. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee any specific performance results from experiments. Analytics data is sourced from third-party APIs and may be subject to delays or inaccuracies outside of our control.
10. Limitation of Liability
To the maximum extent permitted by law, Backsurge shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including revenue loss, data loss, or platform account actions. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Modifications to Service & Limits
We reserve the right to modify, suspend, or discontinue any part of the Service at any time and without liability. This includes changes to feature availability, usage quotas, storage limits, and API rate limits. We will make reasonable efforts to provide advance notice of significant changes, but are not obligated to do so for changes made for security, legal, or operational reasons.
12. Termination
We may suspend or terminate your access at any time for violating these terms or for any other reason at our discretion. You may cancel your account at any time. Upon termination, your access to the Service will cease and we may delete your data in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Backsurge operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
